The buyer has the right to return an iPhone that is under warranty to the seller. In this case, the store is obliged to pay the consumer by returning the full cost of the phone. From time to time, conflict situations arise due to the buyer’s lack of a receipt. Without it, stores often refuse to accept expensive phones back. This position of employees is inappropriate for several reasons:

When returning an iPhone without a receipt, a citizen has the right to prove the fact of purchase with testimony. There are enough of them to start the procedure of exchanging goods for money. However, the buyer should not expect that the amount paid for the iPhone will be returned to him on the same day. Most likely, the seller will send the device for examination to make sure that the malfunction was not the fault of the owner.
A significant advantage of replacing an iPhone is that the buyer receives a new device with a nullified warranty period. However, service centers have strict requirements for returned phones. The buyer will not be able to return either “gray” or stolen equipment. If the item has not yet been delivered to you, you can already refuse it. After the transfer you can cancel within seven days. If the seller does not attach documents indicating the procedure and terms for returning goods of proper quality, you can refuse the goods within three months from the date of its transfer.
To return the product, it must not be in use, its presentation, consumer properties, as well as a document confirming the fact and conditions of purchase of the product must be preserved. If there is no such document, then you can refer to other evidence of purchasing the goods from this seller (a screenshot of the online store’s personal account, a purchase notification by email or SMS).

Any consumer has the right to return a product that meets quality standards within fourteen actual days. This period does not include the day of purchase. Decree of the Government of the Russian Federation dated January 19, 1998 No. 55 approved the List of non-food products of proper quality that cannot be returned or exchanged for similar goods of other sizes, shapes, dimensions, styles, colors or configurations.” It includes telephones as well. The return procedure in this case occurs in the following order:

The request for a refund for the iPhone should be submitted to whom it was paid, that is, to the seller. To request replacement or repair of the device, please contact the service center. Its employees have similar replacement phones and genuine, non-counterfeit parts that allow them to repair expensive equipment.
Experienced iPhone users advise: if the phone breaks down, it is more profitable for its owner to contact Apple support directly rather than to the service centers authorized by the corporation. This gives the buyer a number of advantages:

The quality guarantee period must be established by the manufacturer. If such a period was not determined initially, it can be established by the seller. This rule also applies to mobile devices. For iPhones, the service life is always set by the manufacturer. During this period, the manufacturer guarantees the buyer uninterrupted operation of the device. However, even the iPhone can have flaws. Signs of defects are detected during use of the product by the user himself.
Among them are:
- Low quality of the image on the display, sound in the speakers, or their complete absence.
- Problems with communication, that is, the device does not detect the operator’s network.
- The phone does not recognize the SIM card and other storage media.
- Software malfunction.
- Lack of programs whose installation is guaranteed by the manufacturer.
- Damage and defects on the body of the device that violate its seal, that is, moisture or dust can get inside.
- Spontaneous startup or shutdown of the device.
- Fast consumption and slow battery recharging.
The reasons for these shortcomings may not only be manufacturing defects. Quite often this happens due to improper transportation and storage of the product. In such situations, the owner has the right to demand compensation from the seller for damage caused.
The reason why the iPhone might break is determined during the expert assessment process, since the nature of the defects cannot always be determined by the seller. This procedure is carried out in authorized organizations, by specialists who have the necessary knowledge, skills and equipment. They determine the causes of the breakdown and give their conclusion. Both the buyer and the seller can initiate the procedure.
Who pays
The examination is carried out on a paid basis. Initially, it is paid by the initiator. It can be a buyer or a seller. The court may also order an examination. If a person asked the store to conduct an assessment, then it would be right for the seller to do this.
The expert conducting the assessment determines the type of malfunction and a list of failed parts.
In his conclusion, the specialist may indicate the following:
- The cause of the breakdown was a defect made by the manufacturer.
- The device failed due to the fault of the seller - violation of the rules of transportation, storage or setup.
- The cause of the malfunction was circumstances beyond the control of the parties: natural disasters, military operations, criminal attacks by third parties, natural wear and tear.
- Guilty actions of the owner - operation of the product in violation of the requirements of the technical instructions, use of the device for other purposes.
If anyone disagrees with the results of the examination, a repeat procedure is allowed on their own initiative or in court.
When they refuse a free replacement
Free iPhone replacement is provided only under warranty. You can make sure that it is still valid on the manufacturer’s official website by entering the serial number of the device. Depending on the type of device purchased, the warranty period ranges from 1 to 3 years. Without a guarantee, even minor operations (for example, replacing the glass of an iPhone 7 plus) free of charge will become impossible.
However, there are a number of circumstances in which there is no point in handing over an iPhone under warranty, since the buyer will be denied free service, including the provision of a new device. This will happen in the following cases:
- the serial number is missing or damaged on the product;
- you hand over a stolen phone to a service center (even if the new owner has nothing to do with the theft);
- damage to the device occurred due to improper operation of the gadget or installation of unlicensed software;
- the phone failed as a result of natural disasters: flood, earthquake, fire;
- Traces of moisture were found in the device;
- you asked for a replacement after they tried to repair your mobile phone outside the service center.
Before you return your iPhone for replacement, you need to check whether this device is certified in Russia. Without this, the device cannot be replaced or repaired. If the phone has external defects (scratches, stains), a replacement will also be refused.
Start and extension of the warranty period
First of all, in the upper right corner of the application, the citizen indicates the full name of the manager, the name and address of the company to which the claim will be addressed.
If you return an illiquid product, you must contact the company directly that creates this equipment. The complaint to the iPhone manufacturer is drawn up in Russian and sent to the main office in Moscow, and not directly to America. This greatly simplifies the procedure for drawing up a document and submitting evidence.
In case of a liquid return (within 14 days) of the goods, the claim is written to the director of the supplier company.
Next, the citizen indicates his contact information: last name, first name and patronymic, address of actual residence, telephone number (mobile or home does not matter) and email address (optional).
The correct name of the document is Claim. You can clarify what the claim is being written for, but this is not necessary (for example, a claim for the return of a phone).
The “body” of the document begins with a statement of factual circumstances. The citizen tells when and under what circumstances the device was purchased, indicating the exact dates and addresses. Here it is worth indicating the smallest details, down to the names of the sellers, but only if they relate directly to the purchase.
In the next paragraph, the acquiring party must indicate the reason for the return. In the case of liquid goods, it does not play a significant role and is only a formality, so you can write whatever you want. Incorrect motivation (if all conditions are met) cannot become a reason for refusing to return.
Next, the buyer refers to Articles 18 and 22 of the Law “On Protection of Consumer Rights” in order to give his claim a more formal appearance and indicate his intention to go to the final point in resolving the issue.
A copy of the document confirming payment is attached to the claim. At the end the date and signature are indicated.
If the iPhone does not fully perform its functions or has completely lost its functionality, then the buyer has the right to file a claim with the seller.
This can be done during the warranty period. The duration of this period is one year. This rule applies to products that were purchased in the Russian Federation and underwent special testing. In addition, the buyer can make claims after twelve months.
The warranty for most Apple products starts from the date of purchase. But an exception is made for iPhones: the beginning of the warranty period is the moment the gadget is activated.
If the faulty device was replaced with a new one, then from the moment it was received the warranty period begins to run again. That is, the buyer has at least another year to make sure that this time he has purchased high-quality equipment.
Will the service accept an iPhone with physical damage?
It would seem that everything is ready - you can safely go and change your iPhone under warranty. But we look at the device and see that it has a few scratches and even a small dent. What to do now? Will our gadget be accepted or “deployed”?
You must understand that the service center has special instructions in this regard. And this is called natural wear and tear of the device. No one expects you to bring your iPhone in perfect condition for repair. Some things are completely acceptable and are not grounds for denial of warranty service.
I came across similar instructions a long time ago (back in the days of the iPhone 4 and 4S) and remembering, I can note that they were talking about even minor cracks (as minimal damage passable for warranty repairs), and not just about “ordinary” scratches and abrasions .

The text of the document must reflect the following information:
- Information about the seller - name, address.
- Data about the buyer - full last name, first name, patronymic, place of residence or actual location. Contact information is also indicated - telephone number, email address, if available.
- Date and place of purchase of the device, its brand, model, cost.
- Duration of the established warranty period.
- Time period for detecting deficiencies.
- Description of the malfunction.
- Buyer's requirements.
- List of attached documentation.
- Date of filing the claim and personal signature of the buyer.
It is necessary to inform the seller that if the application is left unattended or the requirements are not met, the person will seek protection of his rights in authorized official bodies - the Federal Service for Surveillance on Consumer Rights Protection and Human Welfare or the court.
The completed claim must be submitted to the store. This can be done in several ways:
- Deliver in person. This option is most suitable for the buyer. The person will be able to verify that the addressee has received the claim. This method allows you to negotiate and solve the problem at this stage.
- Send by mail. This is true in cases where the buyer is located at a considerable distance from the seller, or is unable to come in person. Examples of such situations are: purchasing an iPhone remotely, illness, the specifics of a person’s work. In such a case, the claim must be sent by special correspondence, with notification of delivery to the addressee.
- Transfer through a trusted person. This method is used mainly in cases where a person has little understanding of the law due to his age. In such situations, you can turn to relatives, family members or friends for help. The legal representative will need to have an identification document and a power of attorney confirming his authority.
- Internet forwarding. This option is used mainly in cases where the device was purchased remotely. To do this, a person must have computer equipment at his disposal to transfer the claim into electronic format.
Documents confirming the fact of purchasing the iPhone must be attached to the application. They are a receipt for payment, a purchase and sale agreement, and a warranty card. It is allowed to send not only original documents, but also their certified copies. The method of submitting a claim is determined by the buyer himself based on his capabilities and the characteristics of the current situation.
Buyer's requirements
When sending a complaint to the seller about the presence of a manufacturing defect or failure of the device, the buyer puts forward certain demands. In accordance with the Law of the Russian Federation, these include:
- Replacement of the product with a similar one.
- Return of the product and, as a result, compensation for purchase costs.
- Repair of the device at the expense of the seller.
Any of the requirements is determined by the buyer.
Replacement of the product is possible if a defect or malfunction of the product is detected.
To do this, a person must return the purchased device to the store. In practice, most often the replacement does not occur on the same day. To eliminate the risk of deception on the part of the buyer, sellers always carry out diagnostics of the product to determine the nature and causes of the breakdown.
In accordance with the PZPP, the exchange period is:
- Seven days from the moment the buyer applies.
- Twenty days if additional diagnostics are required.
- Thirty - in case the seller does not have the goods.
If the replacement period is more than seven days, then at the buyer’s request the seller issues an analogue for temporary use. It should be noted that the policy of iPhone manufacturers is such that the causes of shortcomings are identified relatively quickly, and in the absence of the buyer’s fault, the latter is issued a new device as soon as possible.
You can also change the product if it simply did not suit the buyer due to color, style, or configuration. However, in most cases, this rule does not apply to technically complex products.
Refund
The buyer has the right to demand a refund for a non-working iPhone. Supporting documents in this case are: purchase and sale agreement, warranty card, payment receipt. Such a demand must be satisfied within ten days from the date of its presentation.
Quite often, sellers, in order to reduce their costs, send the product for repair. According to the law, the period of work of this nature should not exceed forty-five days. In case of violation of the specified period, the buyer has the right to demand the return of funds, as well as pay a penalty for each day of delay.
Where should I take my iPhone under warranty - to a store or service?
The very first thing is to decide where we will take our iPhone for warranty repair. Here the choice will be small:
- To the store where the device was purchased.
- To an authorized service center.
The buyer has every right to go where it is more convenient for him. But even if you take your iPhone to a store, it will eventually be sent to a service center. And this will be convenient only in one case - when it is not possible to visit the ASC on your own (for example, but it is very far away).
In all other cases, it is better to take the iPhone to a service center yourself. Why?
- In 99% of cases it is much faster. By law, the store has 45 days to fix the defect in your smartphone. As a rule, this is the number of days you will be without an iPhone (well, maybe a little less). Yes, you can ask for a replacement phone number, but not everyone knows about it. And they don’t always give it, preferring to pay a fine.
- In the service itself, all issues are resolved much faster.
- In a store, you can spend a long time explaining and arguing with salespeople about why you brought your iPhone back. In some cases, they won’t even want to accept it :) For example, today their program, printer, doesn’t work, there’s no person working on it, you need to bring a check, an application, an invoice, a bunch of other papers, etc. In this sense, the service is simpler.
Of course, everything written above is greatly exaggerated, but the general meaning, I think, is clear. Therefore, if possible, it is better to submit your iPhone for warranty repair directly to the service - it will be faster (that’s for sure) and you will spend less nerves (this is in question).

Is it possible to return an iPhone back to the store if it “doesn’t fit” - what does the ZPP say?
In terms of returns, the same rules apply to iPhones as to other mobile devices. The PDO gives consumers the opportunity to return the product within 14 days of purchase, even if it is in perfect order. However, the same regulatory act contains a list of technically complex goods (Government Decree No. 55).
The list includes the item “radio communications, radio broadcasting and television of general use.” According to the OKP (general classifier of products), a cell phone belongs to the category “portable transceiver station.” It turns out that Russian legislation recognizes the iPhone as a technically complex device, which means that no one is obliged to return the money for it within 2 weeks and will not.
It is interesting that this list was formed and came into force back in 1998, but the “peak of its popularity” occurred in the last 3-4 years, during which a significant part of Russians acquired smartphones.
An iPhone without a defect can be returned to the store only if the seller hid any information about the product - for example, he sold a refurbished gadget under the guise of a new one (Article 10 of the PZPP). You need to return the restored iPhone through a claim. If the response to the claim is negative, the buyer has the right to consider that he is lucky - through the court he will receive an amount that is enough for a couple of new smartphones.
Arbitrage practice
One of the courts of the Russian Federation considered a person’s claim against a company for refusal to fulfill contractual obligations, return of deposited funds, compensation for moral damage and legal costs, as well as payment of a penalty.
During the study of the content of the appeal, the following was established. A man bought an iPhone model in a store. During the operation of the device, a number of shortcomings were discovered - the phone froze, turned off and restarted spontaneously, and the battery did not charge well. Subsequently, the device could not be turned on at all.
The defendant was sent a claim demanding the return of funds. The appeal was delivered to the seller. In his response, the seller suggested returning the product to the place of purchase. However, the plaintiff's representative was refused to accept the goods back four times. In this regard, the seller was sent a second claim for a refund for the faulty device, to which no response was received.
The representative of the defendant asked to reduce the amount of fines due to their overestimation.
In the process of studying the presented materials, it was established that the plaintiff actually purchased an iPhone and, during its operation, identified a number of shortcomings. In accordance with the examination conclusion, the device had significant shortcomings that made it difficult to fully operate. The specified defect was allowed by the manufacturer.
Based on the above, the court made a decision. The plaintiff's demands were partially satisfied. The purchase and sale agreement was cancelled. The defendant was ordered to compensate for the moral damage caused, to compensate for the costs of postage and the execution of a power of attorney. The plaintiff, in turn, had to return the faulty phone to the seller.
How to return an iPhone with a fault under warranty?
An iPhone that has a manufacturing defect can be returned to the store, but only within 14 days from the date of purchase. Unfortunately, consumers who get information from the Internet often receive incorrect recommendations that are unreasonably reassuring: “pseudo-experts” claim that you can return an Apple gadget to a store during the entire warranty period. This is a lie, probably due to incompetence.
In fact, the legislation establishes the following procedures.
A citizen should take the gadget to the salon and insist on an examination. Without the approval of an expert, money will not be returned, even if the breakdown is completely obvious. It is important for the selling company to make sure that the defect was not caused by the inept actions of the buyer himself.
If you do not insist on an examination, the salon employees will definitely send the gadget for repair, because returning the money is not in their interests. Any salon has a turnover plan, expressed in rubles - in case of return, the cost of the smartphone is deducted from the achieved result.
The employee’s refusal to accept the iPhone for examination is unlawful. The duration of the examination should not exceed 20 days - if the deadlines are missed, the buyer will be given money or a new iPhone of the same modification. If the gadget is returned to the store on time, the further development of the situation depends on the “diagnosis” of the expert.
There is a manufacturing defect. This means that the salon employees must open the cash register and give back the money spent on the purchase of the gadget. An alternative is to replace it with another gadget. It is this option that employees usually insist on, because the exchange will allow them to keep up with the plan. However, the choice of the form of compensation is always up to the buyer.
There is no manufacturing defect. In this case, the buyer is given a gadget, a document with a “diagnosis” and an invoice for signature.
Situations where buyers “invent” a defect are quite common. For example, if a factory worker has calloused fingers, he will probably not be able to handle the iPhone touch screen - an attempt to take the device to the store because “the display does not work” will be unsuccessful, because the gadget is actually working.
The buyer may mistake one of the iPhone's emergency modes for a manufacturing defect. For example, in DFU MODE the gadget does not show any signs of life at all until it is connected to iTunes (everything about the DFU mode is described here). Naturally, the expert will write that there is no shortage. The buyer will be given the smartphone back in good condition with new firmware, and this will not be considered a repair.

However, the buyer still has a chance to return the money for the iPhone. It lies in this: the law allows a period of 45 days for warranty repairs. If the seller does not comply, the buyer should come to the salon and write a claim. At this point we can assume that the money is already in your pocket.
Refunds are also made if the iPhone cannot be repaired or if the restoration work is too expensive. Salon employees in such situations, as a rule, invite customers to pick up a new gadget of the same modification, without mentioning the possibility of receiving cash.
If a fault is detected within the first 15 days from the date of delivery of the goods, then you have the right to return the goods or exchange them for the same or similar ones with a recalculation of the price.
Important: the countdown of the period begins from the moment the goods are received. If you paid for the product and it was delivered to you a week later, then the non-guaranteed return period is calculated from the day of delivery.
The money must be returned to you within 10 days, and a replacement must be provided within 7 days from the date of application (if with quality control, then within 20 days).
Important: if the price of a product has increased since the date of purchase, you have the right to demand compensation for the difference in price.

- During the inspection, the seller is interested in establishing that the cause of the problem was your fault, so we recommend that you be present during this inspection (you have this right). The result of the check may be satisfaction of your request for a replacement, or refusal.
- If you and the seller have a dispute about the causes of the malfunction, the seller is obliged to conduct an independent examination (where you can also be present) at his own expense. If the examination reveals a manufacturing defect, the seller is obliged to replace the product. If, on the contrary, the defect arose during operation, then you will be left with faulty goods and will be required to pay the seller the costs of conducting the examination.
- If the consumer does not agree with the seller and the results of the examinations, then he has the right to file a claim in court.
How to return a phone within 14 days?
If it turns out to be of adequate quality, then no way.
According to Article 18 of the Law “On Protection of Consumer Rights”, you can return an iPhone to the store under the following circumstances:
