All aspects regarding the return and exchange of jewelry are regulated by Federal Law 2300-1 “On the Protection of Consumer Rights.” In accordance with it, jewelry of good quality does not qualify as goods subject to exchange or return.     Is it possible to return a wallet of proper quality?

    The consumer has the right to exchange a non-food product of proper quality for a similar product from the seller from whom this product was purchased, if the specified product does not fit in shape, dimensions, style, color, size or configuration.     The materials from which wallets and purses are made are represented by a wide range:

    • canvas, burlap, drape, corduroy, boucle, jeans, with synthetic fibers, etc.;
    • raincoat fabric, bologna, etc. water-repellent fabrics;
    • natural and synthetic leather, suede and others.

    Any size and regardless of the material from which it is made, a women's bag must be returned if defects are detected in it.

    As Art. 18 PLZPP of the Russian Federation, goods of inadequate quality can be returned to the store by requesting:

    1. replacement with a similar model;
    2. replacement with a similar item;
    3. repairs at the expense of the seller;
    4. markdowns (according to the shortage);
    5. refund.

    Disadvantages may be:

    • the handle (or both) came off;
    • the zipper turned out to be inoperative;
    • the stitching is sloppy, spoiling the look;
    • torn lining;
    • rhinestones, metal or plastic design elements have broken or fallen out, etc.

    A consumer who applies for the return of a low-quality handbag should keep in mind that the determining factor is whether the seller warned about the presence of defects (Article 8 of the RF PZPP).

    Once informed of the defect, the buyer does not have the right to return a bag with a defect.

    A frequent case is the buyer’s desire to return a bag to the store that does not suit the color, style, configuration, size, presence of the required number of pockets, etc., but is of quite high quality.

    Art. 25 of the RF PZPP states that the consumer has the right to return goods of proper quality if all conditions are met.

    The list of requirements for the store in this case is Art. 25 is limited, allowing only the replacement of the bag with a similar one, and a refund is allowed if the seller is unable to make a replacement.

    Terms and procedure

    The consumer will be able to return a bag of proper quality that he does not like or does not fit to the seller under the conditions specified in Art. 25 PZPP RF:

    • labels, tags, tags are intact;
    • the item has never been used - the handles are not wrinkled or worn, the lining is clean, the top and pockets show no signs of use;
    • there is a receipt, although this is not necessary;
    • 14 days have not expired (excluding the date of purchase).

    If this is exactly the case, then the buyer has the right to come and ask to exchange a new bag, and only if there is no similar wallet for a replacement, they will give the money, and then not immediately, but within 3 days.

    As a rule, in such cases, a replacement is made without any special objections, because the bag does not fall under any of the clauses of the documents limiting the return of this particular category of goods.

    There should be no problems with returning a low-quality wallet. The buyer should prepare a claim (2 copies), do not forget the passport, warranty card and receipt or delivery note and go to the very store where the low-quality product was purchased.

    In the case when oral negotiations ended successfully and you were asked to fill out a return application form (or write a paper in free form), then the procedure then proceeds according to the legal algorithm:

    • the seller prepares an act of acceptance of the defective handbag, the client signs this act and gives back the unsuccessful item;
    • Depending on the buyer’s requirement, the seller issues a replacement of the product, a discount, repair or refund.

    If the dialogue does not work out, the client submits his claim against signature to the seller and waits for a response within the 10 days .

    If refused, the consumer has the right to resolve the issue in court by filing a lawsuit, but such a step will be effective under the following conditions:

    • the bag is really expensive;
    • the defect was not the fault of the buyer.

    The fact is that in controversial cases, an examination will be carried out regarding the cause of defects in the goods, and if the bag is torn because the owner got caught on a nail, fittings, etc., then you will not be able to win the case and you will also have to pay for the services of experts.

    The presence of a manufacturing defect or defects that arose before the buyer received the goods are the reasons that provide grounds for going to court.

    Deadlines

    You can return a bag to the store if there are no complaints about the quality within 14 days, not counting the date of purchase.

    A low-quality wallet, briefcase, clutch, etc. may be returned to the seller within the following terms:

    • during the warranty period;
    • for 2 years (without warranty).

    How to return a wallet with a defect under warranty?

    Has it been less than 15 days?

    If a defect is detected within the first 15 days from the date of delivery of the goods, then you have the right to return the goods or exchange them for the same or similar ones with a recalculation of the price.

    Important: the countdown of the period begins from the moment the goods are received. If you paid for the product and it was delivered to you a week later, then the non-guaranteed return period is calculated from the day of delivery.

    The money must be returned to you within 10 days, and a replacement must be provided within 7 days from the date of application (if with quality control, then within 20 days).

    Important: if the price of a product has increased since the date of purchase, you have the right to demand compensation for the difference in price.

    Has it been more than 15 days?

    After this period, you can only count on warranty repairs of the product.

    Although, if the repair lasts more than 45 days, or the fault turns out to be unrepairable or recurring, then you have the opportunity to demand a replacement or refund.

    You can also demand compensation for losses associated with the sale of a device of inadequate quality to you. For example, compensation for the costs of transporting goods to the place of repair.

    Replacement during repair

    While you are waiting for the product to be repaired or replaced, you can request a replacement from the seller during this period. You must be provided with a replacement within 3 days.

    How to return a damaged wallet under warranty

    1. if the warranty period has not expired, you should contact the seller (manufacturer, importer) with a written claim, drawn up in two copies, with clearly stated requirements (copies of all necessary documents are attached to the claim, for example, a sales receipt, sales receipt, warranty card, etc. .).
    2. the seller accepts the product and replaces it with another, or conducts a quality check (in your presence). Don't forget to get an acceptance certificate from the seller.
    3. During the inspection, the seller is interested in establishing that the cause of the problem was your fault, so we recommend that you be present during this inspection (you have this right). The result of the check may be satisfaction of your request for a replacement, or refusal.
    4. If you and the seller have a dispute about the causes of the malfunction, the seller is obliged to conduct an independent examination (where you can also be present) at his own expense. If the examination reveals a manufacturing defect, the seller is obliged to replace the product. If, on the contrary, the defect arose during operation, then you will be left with faulty goods and will be required to pay the seller the costs of conducting the examination.
    5. If the consumer does not agree with the seller and the results of the examinations, then he has the right to file a claim in court.

    How to return a bag back to the store?

    According to the Law “On the Protection of Consumer Rights,” the bag is included in the list of non-food products that can be returned in the first two weeks from the date of purchase if they do not suit the buyer in shape, size, color or configuration. How to do this correctly? What conditions must the seller meet in order to return the bag to the store? Read in the article.

    This Law regulates the rules and conditions for returning food and non-food products back to the store. In addition, it specifies the buyer’s rights when returning/exchanging goods in the store.

    Thus, having purchased a non-food product in a store, a consumer can:

    • Return it back to the store within the first fourteen days (not counting the day of purchase) if the product turns out to be of unsuitable shape, style, dimensions, color, size or configuration;

    It follows from this that the buyer has the right to return absolutely any item to the store that he simply did not like based on one of the listed characteristics. At the same time, he has the right to either return the item in exchange for the money spent (one hundred percent of the cost, without deductions), or exchange it for a similar (in price category) item of a different color, style, size or configuration.

    In addition, the buyer can exchange a previously purchased item for a more expensive/budget item by recalculating the payment amount. If he chooses a more expensive item, he will have to pay the difference in cost. If he chooses a cheaper product, the seller will refund him the difference.

    • Return the item back to the store if it turns out to be of poor quality;

    In this case, the buyer may demand a refund of one hundred percent of the cost of the defective product (in exchange for the return of the product); return the product for repair at the expense of the retail outlet where it was purchased; demand a reduction in the cost of goods due to identified low-quality elements; exchange for a similar product, but of good quality;

    • Return the product to the store based on the current warranty period;

    Thus, such things as shoes, bags, coats, jackets and other items of clothing have a warranty period during which the item can be returned if defective parts are suddenly discovered. In addition to the return, the buyer can count on the store to take responsibility and repair, for example, defective boots at its own expense.

    How to return a bag?

    You can return a bag you don’t like (of good quality) back to the store within the first two weeks of purchase, subject to the following conditions:

    • The buyer will keep a receipt that confirms the purchase of this bag at a specific retail outlet;

    However, if the buyer accidentally lost or simply threw away the receipt, there is no need to despair. If the bag was purchased less than thirty days ago, then the store can ask you to remove the cash register tape, which stores all purchases made by customers over the past month.

    In addition, an alternative to a lost receipt can be a tear-off receipt, which is usually placed in a bag along with the receipt and the purchased product, or an eyewitness to the purchase (a friend with whom the bag was purchased or someone from the store staff).

    • The bag itself has retained its original presentation. In other words, if returned within 14 days, the bag looks the same as when the buyer picked it up from the store;

    In addition to the external “appearance”, all tear-off tags, inserts, stickers, and labels with spare parts must be preserved on the bag.

    • When returned, the bag must not have signs of use (dents, scratches, worn parts, torn parts, stains, etc.);

    What should I do to return my bag?

    Having made sure that the bag has retained the required appearance, and you still have the receipt in your hands (or there is a witness), you need to decide what goal you are pursuing: you want to return the money or exchange the bag for another.     • Collect the bag, pack it in the box/packaging in which it was placed/packed at the time of purchase. Take a receipt/tear-off receipt or other document that indicates the date, price and store where the bag was purchased;
    • Make sure that no more than fourteen days have passed since the date of purchase (do not count the day of purchase);

    So, if a bag was purchased on December 1, and today is December 15, then it will no longer be possible to return the bag on the 16th due to inappropriate color, shape or size. You can exchange a bag after this period only in two cases: if the bag has a warranty period or if the bag turns out to be defective.

    • Since you will have to fill out a return application in the store, you need to take an identification document (passport) with you;
    • In the store, explain the reason why you want to return the bag to the store, then provide the bag and all documents issued for it (receipt, receipt, warranty card, etc.);
    • The seller will ask you to fill out a special application;

    The application contains the following information:

    • details of the consumer and the retail outlet where the bag was purchased;
    • Click to continue, description of the bag, its price and the reason why you brought it back to the store (money refund, exchange for an analogue with suitable characteristics);
    • recording the date of purchase with a document confirming the date (check, receipt, witness testimony);
    • legislative reference (to the Law “On Protection of Consumer Rights”) listing all mandatory conditions;
    • an indication of the possible consequences in case of dissatisfaction with the requirements of the consumer (you);
    • indicating the day/month/year of the submitted application for return/exchange of the bag;
    • personal signature of the consumer;

    If you are returning a bag to the store that turns out to be defective/poor quality, then the application must indicate in detail what the defect is and under what conditions it was detected.

    What's next?

    After filling out the application form, the store may offer you:

    • Exchange the bag for one similar, but different in color, shape or style from the one being returned;
    • Refund 100 percent of the cost of the purchased bag in exchange for its return;
    • If the bag is returned due to its poor quality, the seller may offer to exchange it for another bag (of similar price), or for the same bag, but without defects;

    Attention: any goods purchased via the Internet are subject to return, even technically complex ones and goods from the list of non-returnable goods.

    The nuances of visiting a shopping center

    If a purchase is made in a stationary store located in a shopping center, then the goods can be returned for various reasons within 14 days. If a defect is detected, then return is allowed within the warranty period. For example, if 20 days after purchase a dress simply comes apart at the seams due to poor quality tailoring, then it can be returned to the store as the item is defective.

    Even if sellers refuse to recognize the marriage, they should defend their rights by threatening to contact Rospotrebnadzor or the prosecutor’s office.     Returning a wallet of good quality

    The quality of goods is regulated by the State Quality Standard (GOST) or technical production conditions (TO), which is indicated in the relevant accompanying documentation.

    According to Article 4 of the Law “On Protection of Consumer Rights”, the seller is obliged to provide the buyer with a product suitable for use and corresponding to the description, taking into account its expiration date and service life.

    If all standards are observed, the wallet is a product of proper quality.

    Conditions

    Based on paragraph 1 of Article 25 of the Law “On Protection of Consumer Rights”, the seller is obliged to accept goods of proper quality subject to the following conditions:

    • The product has not been used
    • Presentation and packaging preserved
    • There is no violation of labels and seals
    • Availability of cash or sales receipts

    Procedure

    The buyer must perform the following actions:

    1. Draw up an application in 2 copies and give it to the seller. One copy remains with the buyer, and a mark indicating acceptance of the application is placed on it. The second copy remains with the seller.
    2. Give the wallet to the seller in its entire package. In this case, labels and seals must be intact. After delivery, the buyer’s copy is marked with acceptance of the goods.
    3. Present a document confirming the purchase of the goods at this particular outlet.
    4. Provide an identification document.

    The application must indicate the requirement. That is, what is needed, a refund or exchange of goods. The seller is obliged to satisfy this requirement within no more than 3 days from the date of filing the application.

    Refusal to accept the application

    If the seller refuses to accept the application, it must be sent to the store by registered mail with notification of receipt. In this case, the recipient must be the head of the outlet. The name of the manager can be found in the “Consumer Corner”, which is in every store. The recipient's address must be actual, not legal.

    If the return period has expired

    The Law on Consumer Rights clearly defines return periods. It was decided that 14 days is enough for the buyer to decide whether he needs the product.

    Return to the online store

    When purchasing a product in an online store, the purchase and sale agreement or accompanying documentation may specify a return period of 7 days. If there is no such clause, then the period for returning the wallet can be extended to 90 days.

    All steps for processing a return are the same as for any retail outlet. In the absence of a cash receipt, it is acceptable to attach to the application an extract from electronic payments or a bank receipt that confirms the fact of payment.

    With such a return, it is necessary to take into account that the payment is returned minus the transport costs incurred by the seller to deliver the goods, but only in cases where they are not paid separately.

    Return by organization

    In trade cooperation, a sales contract is always concluded between organizations. If it is necessary to return the goods, it is carried out in accordance with this agreement.

    In some cases, with the consent of the seller, a reverse sale and purchase transaction is concluded, according to which the seller and buyer change places.

    Sample application for return

    The return application is drawn up in 2 copies in free form. The text must contain the following data:

    • Buyer information;
    • Seller information;
    • Purchased item;
    • Date of purchase;
    • Product category;
    • The reason for the return must be stated;
    • Presentation upon return;
    • Request for exchange of goods or refund.

    In case of exchange of goods of good quality, the costs of delivery and return of the goods to the seller’s warehouse will be withheld (Article 26.1). For free delivery, courier costs of RUB 550 are charged. for each position.

    Buyer's note. Reception/receipt of goods. Upon receipt of the goods, you have the right to check the appearance, presence of defects and complete set within 15 minutes.     Returns or exchanges of goods of good quality are made within 14 days.

    In the regions of Russia, returns are made to the appropriate transport company. In accordance with Article 26.1 “Remote method of selling goods”, you have the right to refuse the goods and demand a refund within 14 days from the date of receipt. This is possible provided that the product is of good quality and has not been used, its presentation, labels, presentation of packaging, purchase documents and complete set of goods are preserved.
