  • sending a court notice in Form 22 by email.

Storage periods for correspondence by mail

The storage period for written postal correspondence, parcels, and small packages from abroad is 30 calendar days from the moment they arrive at the post office. An additional extension service is available for storing custom packages. So, if you write an application indicating passport information to extend the retention period for a parcel or letter and provide it to the post office employees, then the storage time for the parcel will be doubled to 60 days.

Unfortunately, there are exceptions with court notices. The storage period here will be only 7 days from the moment they are received by mail and has no extension period. These documents must be taken especially seriously in order to avoid various unforeseen situations. For example, if the judicial mail is returned back to the court with a note that the client refused to receive it, these authorities will regard this as the fact that the person has been notified (if we are talking about the consideration of the case) and will begin the execution of the administrative or civil case without the participation of the person himself.

A fine may be imposed for the failure of the recipient of the registered notice to appear. It would be useful to note that this method of notification calls not only the participants of the parties to the process, but also witnesses in the case. Therefore, there is no need to worry ahead of time. The court notice arrives no later than 15 days before the date of the hearing.

When the registered packet has completely expired, it is sent back to the originating address at the sender's expense. An unclaimed envelope, postcard or parcel remains in the mail storage facility for 6 months. If the sender never picks it up, then after six months the envelope is destroyed.

A Form 22 Court Notice is a procedural document used to notify parties of upcoming legal proceedings. This form can be sent either in paper document format using postal services, or in the form of an electronic document using the Internet.

  • if earlier, during court proceedings, the parties to the proceedings filed petitions for the inclusion of certain evidence in the case, the court notice in Form 22 displays an indicative plan for the provision of this evidence;
  • information that a person who has received a court notice in Form 22 and fails to appear to participate in the court hearing may be held accountable in accordance with the current legislation of the Russian Federation;
  • the notification is sealed with the signature of an employee of the court authorized to sign court notices in Form 22, indicating the date of signing and the seal of this court.

Please note that if a judicial notice in Form 22 is sent in the form of an electronic document, it is sent to the email address that was previously specified by the recipient. They must be sent with an email read receipt. Thus, a citizen who acknowledges having read the email to which a Form 22 court notice has been attached is deemed to have been duly notified.

It is not always possible to call the branch to ask postal operators for sender information. And if you get through with the call, then postal employees may refuse to provide information due to official instructions. Then we try to get out of the situation ourselves in a simpler way, for this you just need to have free access to the Internet. For the recipient, the most important thing is to see the digital number among other information on the mailing slip. As a rule, it is located at the top of the form under the barcode. It is this identifier that provides complete information about the sender. This track number consists of 14 digits, where the first 6 digits are the postal branch code, the remaining 8 digits are a unique parameter of this parcel.

If the letter is received by the legal representative of the citizen to whom the letter is addressed, then, in addition to an identity document, you will need to present a power of attorney confirming the authority of the representative.

What kind of notice is considered improper?

The duty to determine jurisdiction, as well as to search for the addresses of the defendant and third parties, is placed by the current legislation of the Russian Federation on the citizen filing the statement of claim.
