Is it possible to refuse a parcel at the post office without paying for the return journey?

In what situations is it necessary to send the parcel back to the sender?

The need for a Russian Post parcel to be returned to the sender may arise in different situations, and the parcel does not necessarily undergo an opening procedure. That is, the reasons may be external, not related to the contents of the parcel, or based on unsatisfactory parameters of the received product:

  1. At the time of receipt of the shipment there is no money to pay.
  2. The buyer does not agree to pay high customs duties.
  3. The parcel is damaged or does not meet the stated parameters. For example, there is a discrepancy in the stated weight of the parcel. That is, it is important that the violation of the integrity of the packaging was not the fault of the recipient. In this case, postal employees are required to draw up a report.
  4. The contents of the shipment do not correspond to the stated order. This situation involves not so much an erroneous investment as a discrepancy with the position indicated on the site. For example, the product is not the same as in the photo or its appearance does not match the description provided on the online resource.
  5. The received copy turned out to be of inadequate quality.
  6. Defective goods.

According to the Federal Law “On the Protection of Consumer Rights”, it is allowed to return a postal item before it is received or after the parcel has been paid for by the customer according to the documents.

Return of goods by cash on delivery

An exchange of a non-food product of proper quality is carried out if the specified product has not been used, its presentation, consumer properties, seals, factory labels are preserved, and there is also a sales receipt or cash receipt or other document confirming payment for the specified product. The consumer’s absence of a sales receipt or cash register receipt or other document confirming payment for the goods does not deprive him of the opportunity to refer to witness testimony.1. A retail purchase and sale agreement can be concluded on the basis of familiarization of the consumer with the description of the goods proposed by the seller, contained in catalogues, prospectuses, booklets, presented in photographs, through means of communication (television, postal, radio communications and others) or other means excluding the possibility of direct familiarization of the consumer with goods or a sample of goods when concluding such an agreement (remote method of selling goods) by methods. Pay attention to the documentation - whether the store has registration and certificates.

As a rule, such documents can be located in sections with the following names: “About us/About the store”, “Information”, “Help”, “Terms”, “Documentation, etc. If there is no such section or you have not found it, ask the site administrator (his email address can be found at the bottom of the page or in the contacts section) to send copies of the documents to you by email. Refused? Think about whether it is worth shopping in this store.

  • Go to the post office and make a written refusal to receive the postal parcel. The application will need to indicate clause 45 of the Rules for the provision of postal services of the Government of the Russian Federation of 2005. In this case, no payment will be charged from the buyer;
  • Ignore the notification of receipt of the parcel and do not show up at the post office at all. After a certain period (usually thirty days), the parcel will be sent back to the seller;

Algorithm of the recipient's actions to return the parcel

The recipient may refuse the parcel before receipt or after opening. It is important to take into account some nuances here.

If the consumer does not intend to receive the order, then he can either notify the customer in writing by writing the appropriate statement, or simply not show up for the parcel. In the latter case, the seller has the right to go to court for reimbursement of the money spent on shipping.

But in most cases, sales representatives do not take the case to court. They use other coercive measures. For example, blocking your personal account on the website until the debt is repaid.

To return unwanted mail to the sender, you must complete the following procedure:

  1. Notify the contractor of your intention to return the goods, and you will need to indicate the reason.
  2. Make a corresponding statement.

  3. Find out the address of the return collection point (it will not necessarily coincide with the departure point).
  4. Calculate the preliminary cost of sending a parcel. This service is available in most cases on the sender’s website. The second option is an online calculator, available on the official website of the Russian Post.
  5. Forward the parcel to the sender.

In this article we will answer the following questions: what rights do the seller and the buyer have when it comes to returning money for goods by cash on delivery? Can the seller return the money? and what consequences can I expect for both? The content of the article:

  • Concept: features and risks
  • Refusal: reasons, features of the procedure
  • Refund

Concept: features and risks Cash on delivery is a remote method of purchasing goods (via the Internet), in which the buyer pays for it only after receiving it at the post office/delivery by courier. In this situation, the main risks fall on the shoulders of the seller, since by sending the goods he is actually left without paying for it.

Author How Simple! With the proliferation of stores selling through catalogs and Internet sites, cash on delivery has become an increasingly popular service at the post office. It makes it possible to pay for the parcel not in advance, but right before receipt. But if you purchased an item that you want to return, you can get your money back, just as if you were making a purchase in a regular store.

Articles on the topic: Instructions 1 Check whether you have the right to return a product you don’t like. This is possible if the product was of poor quality. Another reason may be that the item does not suit you in color, size or style. But keep in mind that some distance selling stores take advantage of the opportunity given by the state and reduce the time frame for returning high-quality goods that are not suitable for customers to one week instead of two, as is established for regular stores.

Return of goods by cash on delivery by mail

Will I be able to get my money back?

Regardless of how the product was purchased, the seller is required to reimburse the purchase price upon return. That is, it does not matter whether the product was purchased in a store or online, the consumer has the right to return the parcel back to the sender and receive the money already paid.

In this case, the transfer fee is reimbursed by the seller, but the buyer will have to pay for the shipping.

Important! Some online stores provide users with the opportunity to issue a prepaid return label. This service is paid, but if necessary, the seller undertakes to cover all costs for return shipping.

What is also worth considering if you cannot pick up the parcel

If you received the product, unpacked it, but then decided to return it, remember that it must retain its presentation and consumer properties. You must also have a document confirming the legal fact and terms of purchase. If you damage the goods, the seller may refuse to return your money based on loss of presentation and consumer properties. If you have lost the payment document, this does not deprive you of the opportunity to appeal to other evidence of purchasing the item from this seller.

Open the product carefully

Carefully open the received product

If you refuse the product you purchased, the seller returns you the amount spent minus delivery costs. The money must be returned within ten days from the date the consumer submits a request for a refund of the funds spent.

When return shipping is not possible

The law prohibits the return of personal and custom-made goods. In this situation, the seller has the right not to return the money paid. And in the event of a trial, the law will be on his side.

In some situations, if post office employees suspect that the parcel contains prohibited goods, they have the right to open it. Accordingly, if this fact is confirmed, the goods cannot be sent back, just as they cannot be received by the addressee.

Easy unconditional return service. Post office

Good day, Habr!

Not long ago, Russian Post launched, but not everyone knows about it yet, even in post offices. And here the question is not even “when?”, but “who?” screws up and loses my parcel. I’ll write right away that the epic has just begun and how it will end is not yet clear. Hachiko waited, and you will wait (c) Russian Post. It all started when I decided to buy a used motherboard for my cell phone. The phone is lying idle with a broken circuit board, and somehow I feel sorry for it. After searching the Internet, I found offers (in Russia) for about 5 thousand rubles. and almost agreed with the inevitable, but looking at Aliexpress I saw offers at half the price. Why not? (This is where the main mistake was).

Well, as they say, all names are fictitious and any coincidence is accidental...

I found a seller who has a good rating, although not many shipments, good reviews and beautiful pictures. Below there were even instructions on how to properly replace it so as not to damage the product. The total cost was just over 2500 rubles, which, in principle, is acceptable.

Fig.1. The long-awaited fee

A friendly seller sent me photos of my board, how it is not locked, all the gigabytes are there, and the fingerprint works great. I was prepared to wait a month, although it was stated that it would be about 2 weeks.

The product arrived on time and I made a note about receipt on the website. After a quick check, a problem was discovered with the modem (most likely) - there was no sound during a conversation and all sorts of freezes were observed. I immediately opened a dispute, sent a video and photos of the board and specifically that the modem was without a compound, so it was removed and apparently was poorly seated. I didn’t bother repairing it because I didn’t know what condition the board underneath was in.

Huangcheng (apparently this is his name) turned out to be a talkative Chinese and gave me a lot of advice on how to properly check the board, assured me that the board was completely working, but I didn’t know how to check it correctly, etc. A few days later he even kindly invited me to agree to a dispute, indicating the return amount as “0 rubles”.

When I clicked on “Refund Guaranteed” on the Aliexpress website (under my product), I saw:

I have already made a refund for damaged goods before, so, in principle, I know how this happens. Having added more “evidence” to the dispute that I didn’t get what I wanted with the purchase, I started waiting again. A few days later, I received a notification from Aliexpress that it was time to end the dispute and was asked to make a “Return of goods and funds.” That is, I have to send the board back and spend money on shipping (I didn’t know about it yet). Hmm, ok...

Things are about to get interesting

Arriving at the post office, I said that I wanted to send a parcel to China.

Once I already had to return an 8GB flash drive, since I bought it with 256GB. Memories flashed before my eyes, how I filled out an incomprehensible postal form for international shipments, tried to estimate the cost of the drive and not make mistakes in the correct fields, indicating the address and full name of the recipient (later it will be clear why).

In the morning hours our post office is empty and only three employees were bored waiting for visitors. I approached the first window with my board, packed in a foam box. The post office employee asked if I wanted to return an item previously purchased on Aliexpress, to which I answered in the affirmative.

“There are no packages, we can offer a box...” she said. “I don’t care...” I answered. “But I don’t know how to send it.”

My parcel passed into the hands of a second postal employee. I moved to the second window. People began to arrive and take up empty seats.

- Let's just rewind it with tape? – suggested the second employee. – No, according to the rules you need a box or bag. – the first one answered. - Let me take a look? – the employee suggested from the third window.

I carefully swapped places with the queue, vacating the second window and taking the third.

– It’s so simple! This is a quick return. – ??? – Now we’ll quickly weigh it and formalize it. You can also rewind it with tape. –!!! – So, 38 grams, give your first and last name. – Shouldn’t I fill out a form with the address and full name of the recipient? - No, we have an agreement, they will sort it out themselves... - Without address and full name??? - Certainly!

I give my information, and a receipt comes out of the cash register. The employee marks the track number with a dot.

Fig.3. Receipt with track for tracking.

- Ready! Here's the tracking number! – So, I owe 263 rubles for sending... in cash or by card? – No, free is an easy free return. – ??? - Well, I told you that we have an agreement.

And it was at that moment that I realized that most likely I would no longer see either the parcel or the money for it.

- But my address is “fu yong zhen san xing gong ye qu 4dong3louB3fang”, the city is indicated as “shen zhen shi guang dong sheng”, phone number... - Young man, we already sent it like this, everything will be fine.

The first thing I did when I got to my computer was to enter the issued tracking number on the pochta.ru website.

The number is breaking through – that’s encouraging. But Mother's Day was last week... Maybe they are already targeting 2020?

Fig.5. Adding a track to Aliexpress

Dear Huangcheng immediately wrote to me “Tracking ticket no.”, like the track is not trackable. To which I sent him a photo of the receipt. In the Aliexpress system, the status has changed to “buyer add tracking details.” Well, add it, add it. True, the period for returning money has doubled (in Fig. 5., versus Fig. 2.)

Conclusion

I have a mixed feeling about the “Easy Return” service. After reading the forums on this topic, I still don’t understand whether everything went correctly. Shouldn't the item I'm purchasing be marked "Free Return" or should I have sent the package for cash as a small package? The names vary on the forums, I have seen both “Unconditional return” and “Guaranteed return”. The check states the amount “Shipment Rate”, but they do not take money. It was not possible to find comprehensive information about the service on the Russian Post website (without registration).

The Aliexpress website clarified the situation a little, which states that the product must have a “Free return” icon, but then how did I use the service? Will the parcel reach the sender?

Thank you for your attention and see you soon! And may your parcels arrive on time!
