Regulatory aspects

The right to compensation contributions is guaranteed by Article 5 of the Federal Law of the Russian Federation. The amount of payments is regulated by established federal and regional standards:

  • Federal ones imply partial compensation of “parental fees” when a child attends a municipal kindergarten.
  • Regional compensation involves payment of an additional part of the “parental fee”, as well as funding for failure to provide a place in kindergarten.

The amount is awarded to one of the parents, if they are divorced, then to the one with whom the child lives, or to the authorized guardian.

The amount of deductions significantly depends on regional administrative bodies, which determine the rate of compensation based on the level of funding of the education system.

At the national level, the following rules apply:

  • compensation for the 2nd child – 50%;
  • compensation for the 3rd (and all others) – 70%.

Who is paid?

Federal Law “On Education in the Russian Federation” No. 273 of December 29, 2012 in Art. 65 provides the following list of persons entitled to a refund of part of the payment for services of preschool children's organizations:

  • parents of a child attending the institution;
  • other legal representatives of a child in kindergarten - guardians and adoptive parents.

The use of the services of a child care facility must be confirmed by a contract; this requirement is mandatory.

Calculation rules

The principle of calculating the amount for each region is different - its determination is the prerogative of local officials. For example, in Moscow, if there is one child in a family, the preference is 20% of the parental fee. If there are two children, then 50%. For the third and all subsequent ones - 70%. Kindergartens have the right to independently increase the size of the discount if their provision allows it.

A similar percentage is paid for food to children of Chernobyl victims. When assigning payments, all children in the family under 18 years of age are taken into account, as well as full-time students under the age of 23 (who have not previously used the right to academic leave).

The total amount that parents receive depends on the region. For example, in Moscow the average parental fee is 3.5 thousand rubles. In the Rostov region - 2 thousand rubles. Therefore, in Moscow the amount of payments is almost 2 times greater than in other regions.

Accrual terms

The legislator obliges the compensation payment to be made by bank transfer to the recipient's account. Account information is provided along with the application; it is important to provide it correctly. In this case, the deadlines provided by law must be observed.

Please note! Funds are transferred once a month, on the latest dates.

You will be able to receive compensation for February only in March. To avoid mistakes, it is better to clarify in advance exactly when the transfer occurs. This can be done when submitting an application or you can seek additional clarification. The employee accepting the documents must inform the applicant in this regard.

What is the situation with private kindergartens?

At the municipal level, parental fees for private kindergartens are not compensated. But in some areas this is done through the introduction of regional compensation rules, which do not replace, but complement the federal ones.

In Yaroslavskaya, compensation for private kindergartens is claimed only by those families whose total income is no more than 1.5 times the subsistence level. Therefore, all standards should be clarified in the kindergarten itself.

Who is entitled to such benefits?

The state provides social support to families with children in need. One of the legally established guarantees is the right to receive reimbursement of expenses for kindergarten services. Citizens are given the opportunity to return part of the funds transferred for these purposes.

Federal Law No. 388-FZ of December 29, 2015 (Article 7) delegates the authority to determine the categories of persons who require support to regional authorities. Also, individual nuances can be determined at the municipal level.

The amount of compensation varies depending on how many children there are in the applicant's family.

The local budget may include funds aimed at additional support for families with children. In this case, the payment due to citizens may be increased.

Note! Authorities at the level of the subject of the Federation and the local level have the right to determine who exactly needs the subsidy the most. The law also gives this right to individual ministries and line departments.

For example, additional benefits are provided to military children. According to Order of the Minister of Defense of the Russian Federation No. 862 dated November 24, 2014, a separate procedure for paying fees for educational services is introduced for them.

In addition to the number of children, an important criterion for applying benefits is the status of the parents. A number of citizens enjoy the right to reimburse 50% of the amount spent on paying for kindergarten services.

In 2020, this benefit was used by:

  • citizens with registered disabilities;
  • preschool workers;
  • called up for military service;
  • liquidators of the consequences of the explosion at the Chernobyl nuclear power plant.

Need to know! Payment for kindergarten services is not required if we are talking about the following groups of children:

  • having disabilities;
  • orphans;
  • low-income;
  • those suffering from tuberculosis;
  • having parents deprived of parenting rights.

Low-income, needy families have the right to a refund of part of the payment made. Often there is only one parent present, and many of them are classified as disadvantaged.

Also, mandatory benefits are provided to persons who take in orphans or children of parents deprived of their rights. In addition, the legislator also supports children with disabilities, as well as seriously ill people. Each region has the right to clarify and supplement the above list based on budgetary capabilities.

Additional support measures may be established at the local level. For example, we may be talking about paying compensation to the parents of a child who is not provided with a place in a preschool institution. Procedure for registration

To process payments, one of the guardians must submit an application to the person authorized to accept documents from the kindergarten (accountant or manager). It is mandatory to submit a package of documents, including originals. After verification, they are returned, scanned copies with stamps are left with the head of the kindergarten.

If a child attends a state educational institution, then the petition is allowed to be submitted remotely through State Services or the MFC.

They may refuse to accept an application if there is 1 child in the family, while regional policy does not provide for charges in this situation. The MFC still accepts the documents, but within 5 days a written response is given explaining why compensation was denied.

Required documents

To process payments, the following documents are required:

  • passport of the person who financially provides for attendance at the kindergarten;
  • birth certificates of all children in the family, for those over 14 years old, provide passports;
  • certificate of marriage or divorce;
  • account details.

The details indicated in the application must belong to the applicant. If the information points to another parent, the application will not be accepted for consideration. Documentation will be returned within 5 days with refusal.

Additional package of documents includes:

  • a certificate confirming the right to receive social benefits, for example, one of the parents is disabled or a Chernobyl survivor;
  • certificate of income for the last quarter, if profit is taken into account when calculating the amount of payments.

When submitting an application to a private kindergarten, other documents may be required; information should be clarified with the director.

How to fill out an application for parental pay compensation

The application form can be obtained directly from the MFC or from the kindergarten itself. It contains the following information:

  • to whom it is addressed (full name of the kindergarten and full name of the head);
  • an application for compensation indicating the basis (availability of a benefit, a valid regional program with a resolution number);
  • applicant's passport details;
  • list of attached documents;
  • a note on the obligation to notify the kindergarten management about changes in marital status;
  • date of filing and signature.

In the presence of the parent, a stamp of the educational institution is placed on the document, which confirms that the application has been accepted for consideration.

Sample

There is no approved form of the form. Each region uses its own template. A sample can be obtained from the MFC or from the head of the kindergarten.

Submitting an application

You can submit a written application directly to the head or accountant of the kindergarten that your child attends, as well as through the MFC at your place of residence. If the parent is unable to personally submit an appeal, then this can be done through a proxy or by registered mail (copies sent must be notarized). You will not need to pay any duties.

How to fill out an application for compensation of parental fees for kindergarten

You can submit a document in two ways: in writing (according to the sample provided by the educational institution) and electronically (through your personal account on the State Services portal or using an electronic medium). According to the law, only the child's official representative (parent or guardian) can do this.

  1. First, the header is designed in the upper right corner. It must indicate the name of the institution, information about the head (full name) and about yourself (full name, address and contact telephone number).
  2. Next comes the name of the document: “Application” is written in the center of the sheet without quotation marks and with a capital letter.
  3. The content part states a request for a compensation payment, informs about the child’s account and what preschool educational institution he attends.

Important! You must provide your passport details (by whom and when issued, series and number).

  2. Leave a line blank where information about legal issues is added. In case of refusal to transfer payments, the reason will be given here.
  3. The last point is the date and signature with a transcript.

For reference! Either parent can apply for compensation.

Parents of a student in both a public kindergarten and a private one can submit a form for reimbursement of fees. The only condition is the presence of a license to provide educational services.

Is tax paid from compensation payments?

Until 2020, personal income tax (13% of the amount) was paid from compensation payments. Then amendments were made according to which compensation was not included in the income of an individual and, accordingly, tax was not deducted from this money. But it is equated to income when considering cases on the assignment of a subsidy, therefore the funds received must be indicated in the declaration.

Almost all parents whose children attend kindergarten have the opportunity to receive a refund of part of the funds for parental payments. The total amount depends on established regional standards, on average 1 - 2 thousand rubles for the first child.

How to apply through State Services

The State Services portal allows you to simplify the procedure for processing this payment. Using the service, documents are submitted without visiting the kindergarten. The email channel is used to transmit information. It is enough to have a mobile phone with Internet connection. This method of handling is aimed at saving time.

The algorithm for processing compensation through State Services is as follows:

  • register;
  • select the “Education” section;
  • create an application.

Note! The document should indicate:

  • information about the parent;
  • personal data of the child;
  • desired method of receiving payment;
  • payment details.

After this, you should study the information in your personal account. Information about the subsidy provided will appear there, or it will be indicated that the payment was refused. The refusal must be justified.
